I have a medical bill question regarding out of network doc in network hosp and misdiagnosis?

I went to an emergency room because of coughing and fever and was told I had penumonia and a blood clot. It was an "in network" hospital with our insurance at the time, but the doctor was not, but I was not advised of this for the week stay I was there, is this our responsibility? Also, during the stay I was misdiagnosed by this doctor and was given blood thinners for a week for a blood clot that turned out was never there and I just had pneumonia. Also, while there a nurse gave me my roommates medicine for high cholesterol. After this, I was very frustrated and have not paid, this was in November of 2008. I am now getting threats from a lawyer regarding this. Is there anything I can do to lower the bill since this doctor was not in our network in a hospital that was and also the fact I was being treated for a blood clot in my lung that was never there in the first place?
